Texas Uniform Trade Secrets Act

Plano Business Litigation Attorney Richard Armstrong, gave a speech to the North Dallas Bar Association in 2014 concerning the newly enacted Texas Uniform Trade Secrets Act. This blog summarizes his remarks in a series of installments designed to enlighten business owners about the Act.

  • In 2013, the legislature of the Lone Star State enacted into law the Texas Uniform Trade Secrets Act, or “TUTSA.” Then Governor Rick Perry signed the law in May, which was then codified as part of the TEXAS CIVIL PRACTICE & REMEDIES CODE §134A, taking effect on September 1, 2013.
  • The most common tort in the realm of intellectual property, misappropriation of trade secrets, is now governed by this statute, so long as it occurred on or after September 1, 2013. Acts of misappropriation occurring prior to that date will be controlled by common law (decisional or case law created by court cases).
  • While there are similarities between the new statute and the old common law remedies, there are also significant differences, which this writer thinks are for the better.
